An accused in the murder of two BJP leaders in 2015 withdrew his temporary bail application Monday after the Gujarat High Court indicated that it was not inclined to grant his request.

Abdul Salim alias Salim Ghanchi is among the 10 accused in the case, charged with offences under the Unlawful Activities (Prevention) Act as well as Indian Penal Code sections 120B (criminal conspiracy), 302 (murder) and 153A (promoting enmity between various groups).

Ghanchi had earlier sought temporary bail for 15 days before an Ahmedabad city sessions court, which rejected his request on November 10.

Submitting that the petitioner has been in jail since 2015 and was last released on parole in August, Ghanchi sought that he be granted temporary bail from November 20 to 27 to attend his nephew’s marriage in Mumbai. He is lodged at Surat’s Lajpore jail.

Opposing the plea, the National Investigation Agency (NIA) submitted that Ghanchi’s brother was already attending the marriage, Ghanchi’s regular bail plea was pending and the trial was currently at the state of examining witnesses.

Following submissions from both sides, Justice Vimal Vyas indicated that he was not inclined to grant Ghanchi relief.

On November 2, 2015, two BJP leaders—the party’s former district president Shirish Bangali and the general secretary of its youth wing, Pragnesh Mistry—were shot dead by two masked gunmen.

It was alleged that the murders were part of a larger conspiracy to dislodge the democratically elected government and create instability in the country by inciting Hindu-Muslim clashes in Bharuch and elsewhere in Gujarat.

The NIA registered an FIR on December 5, 2015, taking over the investigation from local police.
